ContactThese General Terms of Sale (the "Terms of Sale") govern the paid services offered by ADVIJU INVESTISSEMENT SAS ("Fibo") through the Fibo application (the "App").
They supplement the Terms of Service. Current prices are also set out on the Pricing page of fibo-crypto.fr.
By using the App's paid services, the User confirms having read and accepted these Terms of Sale. They are available at any time in the App and on fibo-crypto.fr. In the event of any discrepancy, the French version prevails.

The App allows the User to swap one digital asset for another, on the same network or between two networks, directly from their non-custodial wallet.
Fibo charges two types of fees: Fibo fees (its commission) and network fees. Their amounts are shown separately in the App before every confirmation.

Before every paid operation, the App shows:

Fibo fees are subject to value added tax (VAT) in accordance with applicable law:

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for paid operations carried out through the App, which are fully performed once confirmed on the blockchain:
The User expressly requests immediate execution of the operation and acknowledges losing their right of withdrawal by confirming each operation in the App.
In accordance with Articles L.224-25-12 et seq. of the French Consumer Code, the service benefits from the legal guarantee of conformity applicable to digital content and services. In the event of a lack of conformity of the software (technical defect preventing normal use of the service), the User may request that the service be brought into conformity, free of charge and within a reasonable time.

The liability provisions of the Terms of Service apply to the services governed by these Terms of Sale. In particular, Fibo cannot be held liable for:
To the extent permitted by law, Fibo's total liability under these Terms of Sale is capped at one hundred euros (€100) per User per calendar year. This cap does not apply in the event of gross negligence or wilful misconduct by Fibo, or in the event of personal injury.
For any complaint about the paid services, the User may write to [email protected]. Fibo acknowledges receipt within 10 business days and responds within 30 days at the latest.
Consumer mediation: in accordance with Articles L.612-1 et seq. of the French Consumer Code, if a dispute is not resolved amicably, the User may refer it free of charge to the consumer mediator to which ADVIJU INVESTISSEMENT SAS belongs, whose contact details are given in the Terms of Service (section 20).
Fibo may amend these Terms of Sale. The Terms of Sale applicable to an operation are those in force when it is executed; new Terms of Sale only apply to operations carried out after they come into force. The User is informed of any material change by a notification in the App or by any other appropriate means, and the prices that apply are always those shown in the App before confirmation.
These Terms of Sale are governed by French law. In the event of a dispute about their interpretation or performance, the parties will seek an amicable solution. Failing this, the courts of Paris will have jurisdiction, subject to the mandatory rules of territorial jurisdiction applicable to consumers (Article R.631-3 of the French Consumer Code).
